Terms and Conditions

You must Agree to all terms and conditions before registering with Monster Auction, LLC.

Monster Auction, LLC at its sole discretion, may ban from further use any buyer or seller which Monster Auction, LLC believes to have in any way misrepresented itself or any item selling, failed to abide by the terms, or conducted any improper auction behavior as determined solely by Monster Auction, LLC. Any seller who misrepresented their items and any buyer who improperly fails to carry through with a purchase will be banned from any further use and may be subject to additional legal actions.

Article 1: ELIGIBILITY OF MEMBERSHIP: This auction site, monsterauction.net, is only available to people who are legally able to form binding contracts. People who are under the age of 18 are not eligible for membership due to state laws concerning the age of majority. If you do not meet these requirements, you are not eligible to use these auction services.

Article 2: Warranties: Monster Auction, LLC is providing Internet auction services. Monster Auction, LLC cannot guarantee the authenticity and quality of a said product, furthermore, Monster Auction, LLC is not responsible for typographical errors, misprints, loss of merchandise/money, damage or failure of equipment. All items sold are AS IS. Items carry no warranty of any type expressed or implied as to the merchantability or fitness for any particular purpose of any goods offered in this sale. All buyers are urged to physically inspect all items prior to bidding. No bids can be withdrawn after being placed. BUYER agrees to all terms mentioned within this document and agrees that these terms may only be revised in writing, signed by an authorized representative of Monster Auction, LLC. BUYER understands that any description given in the catalog or written on the equipment is not guaranteed, and BUYER will rely entirely on their own inspection ( Monster Auction, LLC allows third party inspectors). All information and descriptions contained in advertising this sale are believed correct, however Monster Auction, LLC assumes no responsibility for errors or omissions.

Article 3: Bidding:

Article 3a: Bidding: As a user, you may bid on products using monsterauction.net.

Article 3b: Binding Contract: As a bidder you know that placing a bid is a binding contract between you and Monster Auction, LLC and a bid cannot be retracted unless by mistake of seller, of typographical error, or other error, due to human error on the seller's part. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. Placing a bid on this auction site, winning, then not paying for the product is illegal in most states, resulting in possible prosecution.

Article 4: NOTICE OF CHARGES: There is no buyers premium added to any auctions conducted at either one of the two Monster Auction locations. However any auctions conducted out side of either Monster Auction facilities may have a buyers premium added. The buyer’s premium in effect will be noted on each auction. You may also call us to find out the exact amount of the buyer’s premium for any auction.

Article 4a: NON REFUNDABLE DEPOSIT: Monster Auction LLC, RESERVES THE RIGHT to charge your credit card 20% or your total purchase(s) immediately following the auction. On auctions conducted outside of any monster auction facility. The balance will be due within 48 hours of auction end and prior to removal, Monster Auction, LLC reserves the right to charge any remaining balance of your purchase price, on your credit card, if the balance is not paid within 2 days. You will not be charged a deposit on auctions conducted at any Monster Auction, LLC facility. The buyer is responsible to make payment for items purchased from auctions located at either Monster Auction, LLC facility. Items must be paid for within 2 days of auction end. If items are not paid for and picked up after 5 days they will be resold and the bidder may be suspended. Purchases payable by cashiers check, check, cash, credit card, or wire transfer. Note that the purchase price is the sum of the bid price, buyer’s premium, sales tax, and shipping/handling, if applicable. All payments must be in U.S. Funds.

Article 5: Removal and Failure to Remove: All purchases must be removed from the auction site without damaging any property and within the time announced or posted. All costs, responsibility and risk of such removal shall be borne by buyer and, in every case; buyer will use prudence and care in such removal. If for any reason buyers fail to remove any of buyer purchases within the time specified, Monster Auction, LLC shall have the right, but not the obligation, in its sole discretion, to recall, discard or remove and store said purchase at buyers sole risk and expense ($10.00 per item), without waiving any rights that Monster Auction, LLC or seller may have against buyer. Storage charges will be the responsibility of the buyer (after five business day removal period). Buyers agree that any property not removed from the onsite location within five (5) days from purchase date will be considered abandoned (NOT APPLICIABLE WITH PREPAID SHIPPING AND HANDLING).

Article 6: Shipping & Handling: Monster Auction, LLC, upon request and payment from buyer, Will ship merchandise. All associated cost with shipping and handling are sole responsibility of the buyer. Shipping request must be made by email or phone within 24 hours of the auctions end.

MONSTER AUCTION, LLC RESERVES THE RIGHT TO REFUSE SHIPMENT OF ANY ITEM CAUSING AN UNDUE BURDON.

Above named shipping shall only apply to items located at Monster Auction, LLC locations 1 and 2. Monster Auction, LLC assumes no responsibility for shipping from third party locations. Insurance on all items shipped are optional at the discretion of the buyer.

Article 7: Sales Tax: All items will be assessed a 6% sales tax, unless proper documentation is presented to fall within an exemption status.

Article 8: Posted closing times: Monster Auction, LLC's current times are approximate. Monster Auction, LLC reserves the right to close early or extend auctions at any time at its discretion. It is strongly recommended that bids be placed early to avoid losing out due to an ill-timed, last minute bid.

Article 8a: Auto extend bidding feature - This feature does NOT allow an item to sell at the end of the auction until there is 5 minutes of bidding inactivity. Example - An item is bid on at 7:59 pm. An auction is scheduled to close at 8:00 pm. When this bid is placed the ending time will automatically extend to 8:05 pm. If another bid is place at 8:03, the auction will extend until 8:10 pm. Therefore, always allowing a bidder time to up his or her bid.. If no bids are placed once the additional time has elapsed, the auction will conclude.

Article 9: Right to Terminate Purchase: Monster Auction, LLC reserves the right to terminate any sale at its sole discretion and shall return any unearned fees and cost associated with a terminated sale.

Article 10: Consent to Suit in Michigan: In the event of legal proceedings arising from this contract or from the auction in connection therewith. Buyer consents to being subject to the personal jurisdiction of the courts of the State of Michigan. Buyer also agrees that venue shall be in Genesee County, Michigan.

Article 11: Indemnification: The BUYER expressly agrees to indemnify and save Monster Auction, LLC harmless from and against all claims, losses, expenses, damage or liability, (including, but not limited to, attorney's fees), directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of Monster Auction, LLC or omissions of Monster Auction, LLC or anyone acting in his/her behalf in connection with or arising from an auction.

If you do not agree to be bound by the terms and conditions of this User Agreement, do not use or access our Services. Do not bid unless you agree to all of the terms above. By bidding you are acknowledging agreement with the terms above.
